New bill for Closers, introduced in the MN Legislature on July 20th entitled “REAL ESTATE DOCUMENT NOTARIZATION; APPEARANCE BY VIDEO AUTHORIZATION DURING PEACETIME PUBLIC HEALTH EMERGENCY.”
This important bill for Closing Agents was introduced by the MN land Title Assoc in conjunction with the County Recorers, and when signed, will only be in effect until January 6, 2021. It temporarily deletes key components of the existing RON legislation MN Statute 358.645, so that there is no requirement for knowledge based authentication, no required RON Commission, and no electronic seal requirement (the old rubber stamp still in use.) However, it still refers to the requirement for an audio and video record of the notarization. “The recording must reflect the items required by Minnesota Statute…(date and time, description of documents, name and address of principals, evidence of ID as per statute, and any notarial fees charged.) The video must meet the requirements set forth, be kept for ten years and made available to Commerce or the Secretary of State upon request. Read the unsigned draft of the bill at the link above.
