NASHWAUK, Minn. — The Minnesota Court of Appeals has backed a rural Nashwauk man who sawed his neighbor’s garage in half in a property boundary dispute.

This is a great  example  of  problems  with encroachments  onto  adjacent  property. A garage and septic system overlapped onto the adjacent property. In a property dispute, the owner of the land underneath a portion of the garage and septic system, sawed down the garage and removed the septic. Needless to say, the owner of the garage sued for $40,000 in damages. It went to court and the judge ruled it was an encroachment and there was nothing illegal about its partial removal. The court of appeals, agreed with the lower court.

Removing portion  of  neighbor’s garage  is  legal.  Classic!!beseman_garage-630x471
